Welcome to SetSaver. By accessing or using our application and website, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use SetSaver.
1. Acceptance of Terms
By creating an account, joining our waitlist, or otherwise using SetSaver, you confirm that you are at least 13 years old and agree to comply with these Terms. If you are using SetSaver on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
2. Description of Service
SetSaver is a workout tracking application that allows users to save, organize, and manage exercise routines. The app is currently in beta, and features may change, be added, or be removed at any time without notice.
3. User Accounts
To access certain features, you may need to create an account. You are responsible for:
- Maintaining the confidentiality of your login credentials.
- All activity that occurs under your account.
- Notifying us immediately of any unauthorized use of your account.
We reserve the right to suspend or terminate accounts that violate these Terms.
4. Acceptable Use
You agree not to:
- Use SetSaver for any unlawful purpose or in violation of any applicable laws.
- Attempt to gain unauthorized access to our systems or other users' accounts.
- Upload or transmit malicious code, viruses, or harmful content.
- Scrape, crawl, or use automated means to access the service without our permission.
- Interfere with or disrupt the integrity or performance of the service.
5. User Content
You retain ownership of any workout data and content you create within SetSaver. By using the service, you grant us a limited license to store, process, and display your content as necessary to provide the service to you.
6. Intellectual Property
The SetSaver name, logo, design, and all associated content are the property of SetSaver and are protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from any part of our service without prior written consent.
7. Disclaimers
SetSaver is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not guarantee that the service will be uninterrupted, error-free, or secure.
Fitness Disclaimer: SetSaver is a tracking tool, not a substitute for professional medical or fitness advice. Always consult a qualified professional before beginning any exercise program. We are not responsible for any injuries resulting from workouts tracked or saved in the app.
8. Limitation of Liability
To the maximum extent permitted by law, SetSaver and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service, including but not limited to loss of data, loss of profits, or personal injury.
9. Changes to These Terms
We may modify these Terms at any time. If we make material changes, we will provide notice through the app or by email. Continued use of SetSaver after changes take effect constitutes acceptance of the revised Terms.
10. Termination
You may stop using SetSaver at any time. We may suspend or terminate your access if you violate these Terms or for any other reason at our discretion, with or without notice.
11. Governing Law
These Terms are governed by the laws of the State of New York, without regard to conflict of law provisions.
